When Law Enforcement Doesn’t Enforce Immigration Laws

There are a number of failings with the current Immigration Laws. Mexico is allowing, or has been allowing, “asylum seekers’ to walk through Mexico on their way to the United States. Illegal Immigrants are able to “walk across the border” at various locations along our Southern Border.

“Undocumented Residents” are not deported when their “Illegal Immigrant Status” is identified. Illegal Immigrants are not called out when they apply to work in the United States. Illegal immigrants are often not convicted of illegal entry when convicted of other crimes.

Creating Laws from the Bench.
Judges chose not to alert Immigration and Customs Enforcement (ICE) when an Illegal Immigrant is in front of them, or a Judge might not enforce the ICE Detainer even if there is one on an Illegal Immigrant. These actions have unintended consequences as Illegal Immigrants “depress” wages by working off the books, and some of them commit even more serious crimes while they live in the United States illegally. Let’s look at some recent stories regarding the Illegal Immigration crisis.

The Immigration Crisis started when the last crisis ended. Immigration was supposed to have been fixed under former President Reagan. Newsmax published an article during 2015 title “Illegal Immigrants: How Many Times as U.S. Granted large Scale Amnesty?” The article lists amnesty being given during 1994, 1997, and 1998. Another article “The Seven Amnesties Passed by Congress (2009)” details the 1997 NACARA Nicaraguan Amnesty Program, the 1998 HRIFA Haitian Asylum Law, the Late Amnesty Program of 2000, and the Life Amnesty Program of 2000.

Pen and Phone instead of Congress. We received the DREAM memo from former Secretary Napolitano, then the DACA Deferred Action for Childhood Arrivals, and DAPA, the Deferred Action for Parents of Americans and Lawful Permanent Residents program. Whereas the Amnesty Programs received Congressional support, the DREAM, DACA, DAPA mess was created by a pen and a phone. No legislation was ever passed.

Immigration Laws must be written by Congress. I am not an attorney. I do not play an attorney on television. Article 1 Section 9 of the Constitution clearly states that “The Congress shall have the Power to … Establish a uniform Rule of Naturalization, and uniform laws on the subject of Bankruptcy throughout the United States. Article 3 Section 2 clearly states that the President must take an oath that says “I do solemnly swear (or affirm) that I will faithfully execute the Office of the President of the United States, and will to the best of my Ability, preserve, protect, and defend the Constitution of the United States.”

Immigration requires federal legislation, not state legislation. The Tenth Amendment, part of the Bill of Rights, clearly states that “The Powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” As “a uniform Rule of Naturalization” is a power delegated to Congress it is not a power delegated to the States. We should not have Sanctuary States, Counties, or Municipalities.

Angel Families: When Immigration Laws Are Not Enforced. Angel Families are those that have had a loved one killed by an illegal alien. Information can be found through the Remembrance Project. Some of the more visible stories pertain to Kate Steinle, Jamiel Shaw, and the Hacking Family, a father and two young children killed by an illegal immigrant in an automobile accident in Texas.

Why write about this now? There was an article published earlier this month regarding a judge,  Shelley Joseph, who allowed an illegal immigrant to be escorted out of her court to avoid detention by ICE officials. This Summer a judge ruled that detainers were invalid. Remember it was a Judge that ruled the “Travel Order” was Unconstitutional before the Supreme Court ruled that it was within the President’s powers to issue the travel ban.

What could possibly go wrong?
There was another story that was published during November regarding an Illegal Alien, Luis Rodrigo Perez, who was arrested for domestic violence in New Jersey. He was released and then committed murder in Missouri. He is accused of killing three people. Another case of an Illegal Immigrant, Franklin Freddy Meave Vazquez, a DACA Immigrant, who was recently arrested for a triple murder aboard a boat in Virginia. How about Juana Loa-Nunez who skipped bail after being involved in a hit and run? How about Reynaldo Mora who has been arrested for possibly impregnating a non-verbal child? There are probably a number of “good news” stories regarding illegal aliens that could be published. This is not one of them.

Illegal Immigrant Receives Law License in California. An Illegal Immigrant was sworn in as an Attorney elley in California during 2014, by the name of Sergio Garcia. An Illegal Alien, Lizbeth Mateo, was appointed to the California Student Opportunity and Access Program Project Grant Advisory Committee (Cal-SOAP) Statewide Committee. If we have Illegal Immigrants breaking the laws and Illegal Immigrants enforcing the laws, and Illegal Immigrants making College education easier for Illegal Immigrants, what is a Legal Citizen of the United States supposed to do?

President Trump has offered the “Four Pillars” Immigration Reform. Famous for his “Build the Wall” announcement when he was running for President, President Trump offered the four pillars approach:

  • Secure our borders and close legal loopholes that prevent the prompt removal of those who cross the border illegally.
  • Nuclear family migration by allowing immigration sponsorships of spouses and minor children only
  • End the Visa Lottery
  • Provide legal status for DACA recipients and certain other DACA-eligible Illegal Immigrants

He has also called for the passage of “Kate’s Law” to address crimes committed by Illegal Immigrants. Kate’s Law was passed in the House and stalled in the Senate.

President Trump ends “every speech” the same way “Together, We Will Make America Strong Again. We Will Make America Wealthy Again. We Will Make America Proud Again. We Will Make America Safe Again. And, Yes, Together, We Will Make America Great Again.” One way we can do all of these things is to build a wall, enforce the Immigration laws that are on the books, de-fund Sanctuary Cities, Counties, and States, and hold officials responsible for the consequences of their actions for not upholding their Oath of Office and not enforcing Immigration Laws. It’s Our Country.

It’s Our Economy.
